Legislative Decree no. 196/2003: Art. 7 - Right to access personal data and other rights

  1. The data subject has the right to obtain confirmation as to whether or not personal data concerning him or her exist, even if not yet recorded, and their communication in an intelligible form.

  2. The data subject has the right to obtain: a) the origin of personal data; b) the purposes and methods of processing; c) the logic applied in case of processing carried out with the aid of electronic instruments; d) the identification details of the data controller, data processors, and the designated representative as per Article 5, paragraph 2; e) the subjects or categories of subjects to whom the personal data may be disclosed or who may become aware of it as a designated representative in the territory of the State, data processors, or data controllers.

  3. The data subject has the right to obtain: a) updating, rectification, or, when interested, integration of data; b) erasure, transformation into anonymous form, or blocking of data processed unlawfully, including data whose retention is unnecessary for the purposes for which the data were collected or subsequently processed; c) certification that the operations as per letters a) and b) have been notified, as also related to their contents, to those to whom the data were communicated or disclosed, except when this requirement proves impossible or involves a manifestly disproportionate effort compared to the right to be protected.

  4. The data subject has the right to object, in whole or in part: a) on legitimate grounds, to the processing of personal data concerning him or her, even though they are relevant to the purpose of the collection; b) to the processing of personal data concerning him or her for the purpose of sending advertising materials or direct selling or for carrying out market research or commercial communication.
